1. Introduction

Welcome to EcoTradition.

EcoTradition is an international-facing brand and platform represented by Avijit Roy. Our purpose is to connect international businesses with India’s remarkable artisan-made products while promoting responsible sourcing, traditional craftsmanship, sustainable choices, and the well-being of artisan communities.

These Terms & Conditions govern access to and use of the EcoTradition website, product information, business enquiries, quotations, and related sourcing and export coordination services.

By accessing this website or engaging with our services, you agree to these Terms & Conditions to the extent applicable to your use. Individual orders may also be subject to separate quotations, order confirmations, invoices, purchase orders, and written agreements. Where an order-specific agreement conflicts with these general website terms, the order-specific agreement will govern that transaction to the extent of the conflict.

2. Brand Identity and Business Relationships

EcoTradition is a brand name used by Avijit Roy to represent the platform internationally. EcoTradition is not, by itself, a separate incorporated legal entity.

EcoTradition serves as a communication, sourcing, and coordination platform connecting international business buyers with Indian artisan-made products and the relevant sourcing, production, and fulfilment arrangements.

The legal entity or individual responsible for supplying a particular order, together with the applicable payment recipient, will be identified in the relevant quotation, order confirmation, invoice, or payment instructions, as appropriate.

Buyers should review these documents carefully before placing an order or transferring funds. No payment should be made to a recipient whose identity and payment instructions have not been confirmed through the applicable transaction documents.

Nothing in these Terms & Conditions changes the legal responsibilities of any party under an applicable contract or applicable law.

3. Intended Buyers

EcoTradition primarily serves international business customers, including:

Our services are intended primarily for business-to-business (B2B) transactions rather than ordinary consumer retail purchases.

4. Products and Handcrafted Variations

Our product range may include hand block-printed textiles, tote bags and utility accessories, wooden handicrafts and kitchen products, Jaipur Blue Pottery, and selected epoxy-resin wooden products.

Product availability, specifications, materials, colours, finishes, dimensions, and other characteristics vary by product and collection. Buyers should refer to the relevant product information, catalogue, quotation, or written specifications for the details applicable to a particular order.

Many of our products are handmade or hand-finished. Minor variations in colour, pattern, texture, finish, dimensions, and appearance may occur because of the materials and traditional production techniques used. Such variations are an inherent characteristic of handcrafted products and do not automatically constitute a defect.

We will endeavour to communicate material product specifications accurately. Where a particular specification is essential to the buyer, it should be confirmed in writing before the order is accepted.

5. Enquiries, Quotations, and Order Confirmation

Submitting an enquiry, requesting a quotation, or discussing a product does not automatically create a binding purchase contract.

Quotations may specify product details, quantities, minimum order quantities (MOQs), prices, payment milestones, production estimates, packaging, shipping arrangements, and other applicable conditions.

Quotations are subject to the validity period stated in them. If no validity period is specified, prices and availability may need to be reconfirmed before an order is accepted.

An order will be considered accepted when the relevant contracting party confirms acceptance in writing, subject to any conditions stated in the quotation or order confirmation.

Buyers are responsible for reviewing product specifications, quantities, prices, shipping terms, delivery arrangements, and payment instructions before confirming an order.

Any subsequent changes to an accepted order must be agreed upon in writing.

6. Minimum Order Quantities and Samples

Minimum order quantities depend on the product category, design, materials, production requirements, and degree of customisation.

As a general guideline:

These quantities are indicative and may vary. The applicable MOQ, sample charges, product selection, and other conditions will be confirmed in the quotation.

Sample availability does not guarantee that every design, colour, or specification will be available for bulk production.

7. Customisation and Private Labelling

Subject to feasibility and written agreement, certain products may be customised to meet a buyer’s requirements. This may include branding, logos, colours, designs, dimensions, materials, packaging, and private-label or white-label presentation.

Customisation may involve additional charges, minimum quantities, development costs, tooling costs, or longer production times.

Buyers are responsible for ensuring that any logos, artwork, designs, trademarks, or other materials supplied for customisation are lawfully authorised for use.

Custom designs, artwork, samples, packaging, and other development materials will be handled according to the applicable written agreement.

EcoTradition’s name, branding, website content, and product imagery may not be used commercially without prior permission.

8. Prices, Payments, and Taxes

Prices are quoted according to the product, quantity, specifications, customisation, packaging, shipping terms, and other requirements of the particular order.

Unless expressly included in a quotation, prices do not automatically include freight, cargo insurance, customs duties, import taxes, destination charges, or other third-party expenses.

For made-to-order production, the usual payment arrangement is an advance of approximately 60–70% before production begins, with the balance payable according to the milestones agreed in writing. The applicable payment schedule may differ for particular orders.

The invoice and payment instructions for each transaction will identify the relevant invoicing party and authorised payment recipient. Buyers should follow the confirmed instructions provided for that transaction.

Production may be delayed or withheld if required advance payments or other agreed payments are not received when due.

Bank charges, currency conversion charges, and transfer fees will be allocated as stated in the applicable transaction documents or otherwise agreed in writing.

Any applicable taxes, duties, and statutory charges will be handled in accordance with the relevant transaction documents and applicable law.

9. Production and Quality Control

Production methods and inspection procedures may vary according to the product and artisan production process.

Reasonable quality checks may be conducted during production or before dispatch. Where agreed in advance, third-party inspection may be arranged subject to availability, scope, timing, and cost.

Buyers who require particular tolerances, material specifications, testing, certifications, inspection standards, or packaging requirements should communicate them before order confirmation. Such requirements will apply only when accepted in writing by the relevant contracting party.

Because many products are handmade or produced through decentralised artisan networks, production methods may not be identical to those used in mass-manufactured factory goods.

10. Production and Delivery Timelines

Production timelines are estimates and depend on product availability, order quantities, customisation, raw materials, artisan capacity, seasonal conditions, quality checks, and other operational factors.

As general estimates:

Certain products, including some Blue Pottery items and products affected by seasonal or humidity-related conditions, may require additional time.

These estimates are not guaranteed delivery dates unless expressly agreed in writing. International transit, customs clearance, port handling, and other shipping-related time are additional to production time unless otherwise stated.

Any expected timeline communicated before order acceptance should be treated as an estimate unless the relevant transaction documents expressly provide otherwise.

11. Shipping, Incoterms, and Customs

Shipping arrangements will be agreed for each order. Depending on the product, destination, shipment size, and commercial requirements, available arrangements may include EXW, FOB, CIF, or other mutually agreed Incoterms.

Where Incoterms are used, the applicable rule, named place or port, and version should be specified in the relevant transaction documents.

Responsibility for transport, export clearance, import clearance, insurance, costs, and risk of loss or damage will be determined by the agreed shipping terms and applicable contract.

Unless otherwise agreed in writing, the buyer is responsible for destination-country import duties, taxes, customs clearance, permits, and other local import requirements.

Buyers should independently confirm that the products can lawfully be imported into their destination country and comply with applicable product, labelling, packaging, and regulatory requirements.

Shipping schedules and delivery estimates may be affected by carriers, ports, customs authorities, weather, and other circumstances outside the reasonable control of the parties.

12. Cargo Insurance

Cargo insurance may be discussed or arranged through the relevant shipping provider, where available and appropriate for the shipment.

The availability, scope, exclusions, insured value, premium, and claim requirements will depend on the insurance arrangement and the applicable shipping terms.

Unless expressly agreed otherwise in writing, the cost of insurance arranged for a buyer’s shipment will be payable by the buyer.

Buyers should review the insurance terms and ensure that the coverage is appropriate for the products, route, and shipment value. Insurance does not replace the need to inspect goods and report damage or discrepancies promptly.

13. Damaged, Missing, or Incorrect Goods

Buyers should inspect shipments promptly after receipt.

If goods arrive damaged, quantities are missing, or products materially differ from the agreed written specifications, the buyer should notify the relevant contracting party as soon as reasonably practicable.

The buyer should preserve the packaging and provide supporting evidence where available, including photographs of the goods, outer packaging, shipping labels, damage, and relevant transport or delivery documents.

Claims may require coordination with the carrier, insurer, supplier, or other parties involved in the transaction. Buyers should also comply with any applicable carrier or insurance notification deadlines.

The appropriate resolution will depend on the nature of the issue, the evidence available, the agreed contract, the applicable shipping terms, and applicable law.

This section does not exclude any remedy or legal right that cannot lawfully be excluded or restricted.

14. Order Changes, Cancellations, Returns, and Refunds

Order changes and cancellation requests must be submitted in writing and are subject to the acceptance of the relevant contracting party.

Once production, customisation, procurement, or other order-specific work has begun, cancellation or changes may not be possible without additional costs or other consequences. Any applicable charges or adjustments will depend on the order status, commitments already incurred, the agreed contract, and applicable law.

Returns, replacements, refunds, and other remedies will be handled in accordance with the written terms applicable to the order and applicable law.

Buyers should not assume that made-to-order, customised, or specially procured products can be returned simply because they are no longer required. Equally, nothing in these Terms & Conditions is intended to remove rights or remedies that are legally mandatory.

The relevant quotation or order agreement should specify any order-specific cancellation, return, replacement, or refund arrangements before payment is made.

15. Intellectual Property

Unless otherwise agreed in writing, intellectual property rights in the EcoTradition website, brand identity, original website content, and associated materials remain with their respective owners.

Buyers may not reproduce, distribute, modify, publish, or commercially use website content, photographs, branding, or other protected materials without appropriate authorisation.

Product designs, artisan artwork, custom designs, and buyer-supplied materials may be subject to separate ownership, licensing, and usage arrangements. These should be agreed in writing where relevant.

16. Third-Party Services

Orders may involve third-party providers such as manufacturers, artisan groups, packaging providers, freight forwarders, carriers, insurers, inspection agencies, banks, or customs intermediaries.

Their roles and responsibilities will depend on the applicable transaction arrangements.

Where a third party is independently responsible for a service, its own contractual terms may apply. This section does not automatically release any contracting party from obligations it has expressly undertaken or responsibilities imposed by applicable law.

17. Limitation of Liability

To the extent permitted by applicable law, no party will be responsible for losses that are too remote or unforeseeable to be recoverable under the applicable legal principles.

Any liability limitation or exclusion must be interpreted consistently with the relevant contract and applicable law. Nothing in these Terms & Conditions excludes liability that cannot lawfully be excluded, including any applicable liability arising from fraud or wilful misconduct.

Any agreed limits, exclusions, or remedies specific to a particular order should be stated in the relevant transaction documents.

18. Events Beyond Reasonable Control

A party will not be treated as having breached an obligation to the extent that its performance is prevented or materially delayed by circumstances beyond its reasonable control, subject to applicable law and the terms of the relevant contract.

Such circumstances may include natural disasters, severe weather, epidemics, war, civil unrest, government restrictions, port closures, transport disruption, significant supply interruptions, or other comparable events.

The affected party should notify the other relevant party as soon as reasonably practicable and take reasonable steps to reduce the impact.

The consequences for production, shipment, payment, cancellation, or refund will be determined by the applicable contract and law.

19. Privacy and Communications

Personal information submitted through the website or during business enquiries will be handled in accordance with the EcoTradition Privacy Policy and applicable law.

Business enquiries may be made through the website enquiry form, email, or WhatsApp, where available. Email is the preferred first point of contact for business enquiries.

Buyers should avoid sending confidential financial information or sensitive personal information through unsecured communication channels unless necessary and appropriately protected.

20. Changes to These Terms

These Terms & Conditions may be updated from time to time to reflect changes in our services, business practices, or legal requirements.

The latest version published on the website will indicate the date of the most recent update. Changes to these general website terms will not automatically rewrite the terms of an already accepted order unless agreed by the relevant parties or required by applicable law.

Buyers should review the current version when using the website or making a new enquiry.

21. Governing Law and Dispute Resolution

These Terms & Conditions and any dispute concerning website use will be governed by the laws of India, subject to applicable conflict-of-law principles and mandatory legal protections.

For disputes arising from a particular order, the governing law, jurisdiction, and dispute-resolution arrangements may be specified in the relevant transaction documents.

The parties should first attempt to resolve any dispute through good-faith written communication. If a resolution cannot be reached, the dispute may be referred to the competent court or other forum determined under the applicable contract and law.

Nothing in this section removes any mandatory jurisdiction or legal right that applies under law.
